These Terms and Conditions (“Terms”) govern the use of the website talkspanishnow.com and the services offered by Talk Spanish Now (“we,” “our,” “us”). By booking or attending lessons, you agree to these Terms.

1. Services

  • We provide online Spanish lessons to international students.
  • Lessons are offered individually, in packages (Essential and Extended), or as Events and Workshops (Group Lessons).
  • All sessions are live (not pre-recorded).

2. Eligibility

  • Our services are intended for individuals 18 years and older.
  • By booking, you confirm that you have the legal capacity to enter into this agreement.

3. Conduct and Use of Services

  • Respectful communication between tutor and student must be maintained at all times.
  • It is strictly prohibited to:
    • Record, reproduce, or distribute any lesson without prior written consent.
    • Share, resell, or transfer lesson access to third parties.
    • Use third-party copyrighted materials in violation of intellectual property rights.

4. Intellectual Property

  • All original teaching materials, explanations, and exercises created by Talk Spanish Now remain our exclusive intellectual property.
  • Students may use provided materials only for personal educational purposes.
  • In some cases, third-party materials or books may be used as part of the lessons. Such materials are employed exclusively for educational purposes and always in compliance with applicable copyright laws.
  • Unauthorized reproduction, distribution, or commercial use is prohibited.

5. Payments and Booking Requirement

  • Payment Integration: All transactions are processed through our integrated PayPal system. Full payment is mandatory at the time of purchase.
  • Booking Requirement: To complete a purchase, students must schedule their lesson (or at least the first lesson in the case of packages). This confirms the start of the service provision and the immediate allocation of tutor resources.
  • Security and Privacy: We prioritize your security. We do not store, process, or have access to your credit card information or financial details; all sensitive data is handled securely by PayPal.

6. Booking, Cancellation, Rescheduling, and Refund Policy

1. General Refund Terms

  • Digital Services: Since our services consist of live sessions and digital bookings, all sales are final. We do not issue cash refunds for any type of lesson or event once the payment has been processed.
  • Commitment: By purchasing a lesson or package, you are securing a professional tutor’s time and dedicated educational resources.

2. Trial Lesson

  • Account Eligibility: This offer is strictly limited to one (1) free trial lesson per person. We reserve the right to cancel any trial lesson if we detect multiple accounts created by the same individual.
  • No-Shows & Cancellations: If a student does not attend (the tutor will wait for 15 minutes) or cancels the free trial, the offer is considered used and no second trial will be provided.
  • Rescheduling: Can be rescheduled at least 12 hours in advance.
  • Validity Period: Trial lessons must be scheduled and taken within a 2-month validity period from the date of purchase. Any lesson not used within these 2 months will expire and cannot be refunded, extended, or credited.

3. Group Trial Lesson (Welcome to Talk Spanish Now)

  • Limited Offer: This is a free, one-time introductory group lesson for new students. Limited to one (1) free group session per person.
  • Cancellations: Allowed at least 24 hours before the scheduled start time.
  • No Rescheduling: Individual rescheduling is not permitted for group sessions due to their fixed schedule, group nature, and limited capacity (maximum 3 students).
  • Verification: We reserve the right to remove participants from the session if they have previously attended a group trial lesson or trial lesson.

4. Individual Lessons

  • Cancellations: Allowed at least 12 hours before the scheduled start time. If you cancel an individual lesson, the lesson is forfeited. No refunds or credits will be issued for cancellations.
  • Rescheduling: You can reschedule at no additional cost if done at least 12 hours before the start time.
  • Validity Period: Individual lessons must be scheduled and taken within a 2-month validity period from the date of purchase. Any lesson not used within these 2 months will expire and cannot be refunded, extended, or credited.
  • No-Shows: Tutor will wait for 15 minutes. After this, the lesson is considered completed and lost.

5. Lesson Packages (Essential and Extended)

  • Availability and Scheduling: All lessons must be scheduled and taken within the 2-month validity period of the package. Booking availability is subject to the tutor’s calendar. We strongly recommend that students schedule all their lessons at the time of purchase or immediately after to ensure their preferred time slots are available and secured.
  • Validity Period: Any lessons not scheduled or taken within 2 months from the purchase date will expire and cannot be refunded, extended, or credited.
  • Calendar Capacity: Purchasing a package provides lesson credits but does not guarantee specific time slots if they are already booked. Talk Spanish Now is not responsible if a student cannot find an open slot due to delaying their booking.
  • Cancellations: Allowed at least 12 hours before the scheduled start time. If you cancel a lesson that is part of a package, the lesson will be returned to your account as credit to be used within the package validity period.
  • Rescheduling: Allowed at least 12 hours before the scheduled start time.
  • No-Shows: Tutor will wait for 15 minutes. After this, the lesson is counted as completed and deducted from your package balance.

6. Events and Workshops (Group Lessons)

  • Fixed Schedule: These sessions are held at specific dates and times as advertised in the Events section.
  • Cancellations: Allowed at least 24 hours before the scheduled start time. If you cancel or cannot attend the event, the lesson is forfeited and no refund or credit will be provided.
  • No Rescheduling: Individual rescheduling is not permitted for group sessions due to their fixed schedule, group nature, and limited capacity (maximum 3 students).
  • No-Shows: The lesson is considered completed and lost.
  • Minimum Attendance: Talk Spanish Now reserves the right to cancel or reschedule an event if the minimum attendance (minimum 2 students) is not met. In this case, affected students will be notified and offered a lesson credit for a future session.

7. General Considerations

  • Non-Transferable Services: Lessons are personal and may not be transferred, resold, or shared with third parties.
  • Punctuality: The tutor will wait for the student for a maximum of 15 minutes. If the student arrives after this time, the lesson will be considered a “No-Show” and will be counted as completed, with no option for a refund or rescheduling.
  • Time Zone Responsibility: It is the student’s responsibility to ensure they are aware of the correct time for their scheduled lesson. All bookings are final based on the time slot selected during the scheduling process.
  • Discretionary Exceptions: In exceptional cases (e.g., severe emergency or force majeure), exceptions to the booking, rescheduling, and refund policies may be evaluated at the sole discretion of Talk Spanish Now.
  • Tutor Absence:
    • If we (Talk Spanish Now) must cancel a lesson due to illness, emergency, or any other non-technical reason, the student will be notified as soon as possible.
    • In this scenario, the lesson will not be counted as taken, and the student will be able to reschedule the lesson for another time at no additional cost or penalty.

7. Technical Issues

In the event a lesson is interrupted or canceled due to technical issues, the following applies:

  • Tutor-Side Issue: If the interruption is caused by a technical failure on Talk Spanish Now’s side (e.g., tutor’s internet failure or similar issues):
    • If the interruption is minor (less than 5 minutes), the time will be recovered by extending the current lesson session.
    • If the interruption is significant (5 minutes or more), the lesson will either be fully rescheduled or the remaining time will be completed at a separate, mutually agreed-upon time, at no additional cost to the student.
  • Student-Side Issue: If the interruption is caused by a technical failure on the student’s side (e.g., student’s internet failure or hardware issues), the tutor will wait up to 15 minutes for the student to resolve the issue. If the session cannot resume within this time, the lesson will be considered completed, and no refund or rescheduling will be offered.
  • Prevention: To prevent technical errors, we strongly suggest taking all necessary technical precautions before the lesson and attending promptly at the scheduled time.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Colombia. Any disputes shall be submitted to the jurisdiction of the courts of Colombia.
